Credit card information is always encrypted during transfer over networks. Certain products or Service may be available exclusively online through the website. These products or Service may have limited quantities and are subject to return or exchange only according to Bouquet Casting Co's Refund Policy (detailed below). Bouquet Casting Co has made every effort to display as accurately as possible the colors and images of Bouquet Casting Co's products on the website. Bouquet Casting Co cannot guarantee that your computer monitor's display of any color will be accurate. Bouquet Casting Co reserves the right, but is not obligated, to limit the sales of Bouquet Casting Co's products or Service to any person, geographic region, or jurisdiction. Bouquet Casting Co may exercise this right on a case-by-case basis. Bouquet Casting Co reserves the right to limit the quantities of any products or Service that Bouquet Casting Co offers. All descriptions of products or product pricing are subject to change at any time without notice, at Bouquet Casting Co's sole discretion. Bouquet Casting Co reserves the right to discontinue any product at any time. Any offer for any product or Service made on this site is void where prohibited. Bouquet Casting Co does not warrant that the quality of any products, Service, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

Section 6 - Refunds

We do not offer refunds for any reason due to the handmade nature of our products and services and the space and resources dedicated to each project. Bouquet Casting Co. reserves the right to only honor refunds at their sole discretion. If shipping instructions are not followed properly and Client wishes to cancel their order, then we may consider a partial refund and retain $400 of the order total. Clients must reach out within five (5) business days to obtain a refund at Bouquet Casting Co.'s discretion. After five (5) business days, no refunds are permitted and we will proceed with the current flowers at hand in their current condition and the current order. Bouquet Casting Co. agrees to communicate all concerns and options to the Client in a timely manner if the quality of the flowers received do not meet the standards of our production as set here on our website. Excessive wilting, mold, browning, discoloration, and other indications of poor and declining quality of the flowers beyond what we can reasonably work with will be communicated to the Client as well as options such as, but not limited to, bouquet recreation or the replacement of select flowers to be purchased to proceed with the order. If Client cancels their order thirty (30) days prior to us receiving their flowers, a partial refund will be considered and we will retain the $200 deposit. For cancellation thirty (30) days and under, Client may receive a partial refund at our discretion and we will retain $400 of the order total. The amount of $400 is our minimum order value and the charge for the spot reserved that can no longer be filled by other clients.

Section 7 - Billing and Account Information Accuracy
Bouquet Casting Co reserves the right to refuse any order you place with Bouquet Casting Co. Bouquet Casting Co may, in its sole discretion, limit or cancel quantities purchased per person, per household, or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that Bouquet Casting Co makes a change to, or cancels an order, Bouquet Casting Co may attempt to notify you by contacting the e-mail, phone number, and/or billing address provided at the time the order was made. Bouquet Casting Co reserves the right to limit or prohibit orders that, in its sole judgment, appear to be placed by dealers, resellers, or distributors. You agree to provide current, complete, and accurate purchase and account information for all purchases made on Bouquet Casting Co's website. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that Bouquet Casting Co can complete your transactions and contact you as needed.

Whenever possible, each provision of these Terms of Service shall be interpreted in such manner as to be effective and valid under applicable law, but if any provision of these Terms of Service is held invalid or unenforceable, the remainder of these Terms of Service shall nevertheless remain in full force and effect and the invalid or unenforceable provision shall be replaced by a valid or enforceable provision.

Section 21 - Turnaround

Turnaround is the time it takes once an order is submitted and we receive a client's flowers to when the client receives their finished products. Due to the time required to properly dry, disassemble/reassemble, craft and design, and the natural curing times of the resin process with everything being handmade to our standards, average turnaround time is 6-8 months for any given order. During peak wedding months, from April through October of a given year, turnaround times may be up to 8 months or longer.

Section 22 - Termination
The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of these Terms of Service for all purposes. These Terms of Service are effective unless and until terminated by either you or Bouquet Casting Co. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use Bouquet Casting Co's Service, or when you cease using Bouquet Casting Co's site. If in Bouquet Casting Co's sole judgment you fail, or Bouquet Casting Co suspects that you have failed, to comply with any term or provision of these Terms of Service, Bouquet Casting Co may also terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to Bouquet Casting Co's Service (or any part thereof).

Section 23 - Entire Agreement
The failure of Bouquet Casting Co to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision. These Terms of Service and any policies or operating rules posted by Bouquet Casting Co on this site or in respect to the Service constitute the entire agreement and understanding between you and Bouquet Casting Co and govern your use of the Service, superseding any prior or contemporaneous agreements, communications, and proposals, whether oral or written, between you and Bouquet Casting Co (including, but not limited to, any prior versions of the Terms of Service). Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.

Section 24 - Governing Law and Dispute Resolution

This Agreement shall be governed by Pennsylvania law. 
Clients and Bouquet Casting Co agree to try to resolve any dispute relating to this Agreement, including the services or payments provided hereunder, reasonably and in good faith through direct communication with each other. In the event any dispute cannot be so resolved, the parties may mutually agree to pursue mediation through a neutral mediator. If such a dispute is not resolved through direct communication or mediation, then any legal action relating to the dispute must be filed in the U.S. District Court for the Eastern District of Pennsylvania in Philadelphia or the Delaware Court of Common Pleas, in Media, PA. Clients consent to the exclusive jurisdiction of these courts for any dispute relating to this contract or the services or payments provided hereunder, and agree to jurisdiction and venue in these courts. Clients also WAIVE any right to a JURY TRIAL to resolve any such dispute. The prevailing party in any litigation of the dispute shall be entitled to payment by the non-prevailing party of its reasonable attorneys’ fees and costs.
